TO BE A CITIZEN

Both on gaining entry to Italy and during your stay, you have to be able to demonstrate three things, with valid documentation:
- the reason and the conditions of your stay;
- how you will be supporting yourself;
- that these funds are sufficient for both the length of your stay and your return to your home Country.

For these reasons all foreign citizens need to permanently carry their passports and their stay permit (or stay card) with them to be shown, if required to do so by the authorities.

The first DOCUMENT to apply for is the stay permit that allows you to:
- register at the General Registry Office at the town council;
- have the Identity Card;
- ask to be issued your Fiscal Code.

Stay permit

The stay permit must be applied for at the Police Headquarters, within 8 working days of legal entry into the country.
Even for eign citizens holding a stay permit issued by a European Union State still need to declare their presence at the Police Headquarters, within 8 days and the permit’s length will be the same as that written on the entry visa.

Renewing your permit
Renewal of the stay permit must be applied for:
- 90 days before its expiry date if you have a job contract of two years in duration;
- 60 days before it expires if you have a job contract of one year in duration;
- 30 days before in all other cases.

The permit should be renewed within 20 days of the application, but not always these terms are respected.

Change of details on your permit

Citizens are obliged to communicate all changes of address, marital status etc. to the Police Headquarters within 15 days. If it needs to be amended a second time, the stay permit will be taken in by the authorities to be renewed.

The Stay permit

Applications for the stay permit (stay card) must be made in person at the Police Headquarters by Non-EU citizen using a specific application form.

In order to get the card you need to:
- have been legitimately resident in Italy for at least 6 years;
- have, when making the application, a stay permit that allows a an indefinite number of renewals;
- have a sufficient income to support yourself and your family;
- have accommodation which complies with Regional Law;
- have not been reported or indicted for a crime.

Fiscal Code

The fiscal code is essential for all citizens for any kind of contract (work, accommodation etc.) and for relations between Government Bodies and Public Administration.
In order to obtain it, the citizens must go to the Revenue Agency Office with their passports or with their stay permit. To register new-born babies for the Fiscal Code, it is enough to bring their birth certificate or self-certification of the date and place of birth, issued by one of the parents.

Registering at the Registry Office

All citizens who legitimately live in a stable and permanent condition are entitled and obliged to be registered at the Registry Office. Registrations at the Registry Office for yourself or dependants living at the same address, must be done within 20 days of the date of the start of your residence.

What to do
In order to register, the citizen needs to show:
Compulsory documents
- a valid stay permit or card;
- a valid passport;
Optional documents
- fiscal code card;
- driving licence if applicable and for those with a car, the log book;
- original documents stating marital status (marriage, divorce, widowhood) - these documents must be in their original language, but be accompanied by an official translation by the Italian Consulate or Embassy in your country of origin, or your country’s Embassy in Italy.
The translation must be certified by the Prefecture.
Documentation regarding marital status is necessary in order to obtain certification of this information. In the event of missing documentation, in the form required, the members of the family will be registered without indicating any family relations.

- Where the applicant is resident in council housing they must present the nulla osta .

- In the event that the applicant joins a family who is already in residence, the head member of the family must sign the applcation.

- In the event of divisions of a family which includes minors a declaration of agreement regarding the transfer to the other parent must be declared.

Renewal of habitual residence

Citizens are obliged to confirm their residential address at the Registry Office in the Town Hall within 60 days, of the renewal date of their stay permit.
A failure to make this declaration, within one year after the expiry of the stay permit or the stay card, will lead to a cancellation of residency by the Registry Office in the Town Hall, in the 30 days that follow.

The ID Card

All citizens, registered at the Registry Office and who are over the age of 15, can request to be issued an Identity Card.
- the Card is valid for 5 years and can be renewed up to 180 from the expiry date.
- the card is not a valid emigration document for foreign citizens;
- the Card, even if valid, does not give foreign citizens the right to stay in Italy if their stay permit has expired or has been recalled;
- the Card does not need to be renewed with a change of address, marital status or profession.

What to do
Citizens over the age of 18 registered at the Registry Office need to provide:
- 3 identical recent passport photographs;
- their original stay permit;
- their passport.

Certificates - Self-Certification

The Town Council issues certificates to everybody registered at the Registry Office regarding residency, family status, birth and death. The certificates can be replaced with self-certification. Self-Certification simplifies dealings with the Administration because it allows you to provide personal declarations in place of traditional certificates issued by the Registry office.
Foreign citizens can use self-certification (substitute declarations of certification) for declarations of personal status, facts and qualities that are certifiable or attestable by public administration or other Italian individuals.
Self-certification is used in dealings with public administration and with agents and administrators of public services, who are obliged to accept it.
The declaration of self-certification can also be presented to private Individuals (for example banks, insurance companies etc.) however these can, but are not obliged, to accept it.
